The following terms and conditions (these “Terms of Service”), govern your access to and use of the TriStar Gym Digital app, including any content, functionality, and services offered on or through the App. 2. Accessing the App and Account Security We reserve the right to withdraw or amend this App, and any service or material we provide on the App, at our sole discretion without notice. We will not be liable if for any reason all or any part of the App is unavailable at any time or for any period. 4. Intellectual Property Rights The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by TriStar Gym Digital, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 5. Prohibited Uses You may use the App only for lawful purposes and in accordance with these Terms of Service. You agree not to use the App: In any way that violates any applicable federal, state, local, or international law or regulation. To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which, as determined by us, may harm the App or users of the App or expose them to liability. 6. User Contributions The App may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit to other users or other persons content or materials on or through the App. 7. Monitoring and Enforcement; Termination We have the right to: Remove or refuse to post any user contributions for any or no reason at our sole discretion. Terminate or suspend your access to all or part of the App for any or no reason, including without limitation, any violation of these Terms of Service. 8. Disclaimer of Warranties Your use of the App, its content, and any services or items obtained through the App is at your own risk. The member assumes full responsibility for his (her) personal injury that he (she) may incur, therefore TRISTAR will not be held responsible and/or liable for any such injury.
